Terms and Conditions of the Pendraqi Store

§ 1

General Provisions

The online store Pendraqi sells watches and accessories via the Internet – online, at the website named Pendraqi.com, based on these Terms and Conditions.
The owner of the Pendraqi store is KOMESSA, NIP 911 181 54 60, with its registered office in Oleśnica, 56-400 ul. Sikorskiego 5a/10, phone: +48578027041, email address: pendraqi@gmail.com.
These Terms and Conditions are an integral part of the sales contract concluded with the Customer. The Customer is a private individual or a company identifying itself with an active account on the sales service pendraqi@gmail.com.
The condition for concluding the sales contract is the acceptance of the Terms and Conditions by the Customer.
A shipping cost selected by the buyer is added to the sale prices in the shopping cart.
The goods available in the store are new and free from physical and legal defects.
The store operates on the basis of the assumptions of unregistered business activity. The status of the store will change once the limits prescribed for this type of activity according to the legal regulations in Poland are exceeded. § 2

Order Status

Orders can be placed online through the website named Pendraqi.com.
The condition for the realization of the order is the provision by the Customer of data allowing for customer and product recipient verification. The Pendraqi.com store confirms the acceptance of the order via email or by phone. We reserve the right to refuse to accept an order, limit the payment method, or request prepayment if the order raises legitimate doubts regarding the accuracy and reliability of the provided data or payment method or incorrect product pricing.
The information on the Pendraqi.com website does not constitute an offer within the meaning of the Civil Code. By placing an order, the Customer makes an offer to purchase a specific good. The sales contract is concluded at the moment the Customer confirms the Order by clicking the confirmation link in the email sent to the Customer by the store.
The prices of the watches are determined individually, and there is a possibility of obtaining a discount.
Orders that are not paid for within 2 days will be canceled.
After the transaction is completed, the purchase invoice will be sent electronically to the email of the purchaser. The sales document is also the basis for filing complaints regarding the purchased product.

§ 3

Payments:

The entity providing online payment services is Autopay S.A.

The customer can choose from the following payment methods:
a) Cash on delivery – in this case, payment is made in cash upon receipt of the goods,
b) Bank transfer – once the payment is recorded in our account, the order will be processed.

Order Process:

e) Traditional bank transfer – in this case, the Pendraqi.com store reserves the goods in stock and ships them to the address specified by the customer after the payment is posted to the bank account indicated for this purpose on the store's website or in the email to the customer.
Shipping costs are specified in the delivery price list or in the shopping cart.
The condition for releasing the goods is payment for the goods and shipping.
An invoice for wholesale customers is issued immediately and sent along with the order to the email address. For customers working in a dropshipping model, a single cumulative invoice for the previous calendar month, including returns and discounts, is issued and delivered from the 7th of the following month to the email address.

§ 4

Shipping of Goods

The ordered goods are shipped via shipping companies available on the Pendraqi.com website. In case of shipment by means other than cash on delivery, the shipping time is extended by the period between the order placement and the date of acknowledgment of the payment in the store's bank account. The Pendraqi.com store is not responsible for delays in the delivery of goods caused by shipping companies. Orders placed by 12:00 PM are shipped on the same working day. We reserve the right to ship within 48 hours of receiving the order and payment acknowledgment. In the case of orders exceeding the stock level, the shipping time may be extended due to the time taken to source the goods from the manufacturer or importer, typically around 2-3 working days. In cases of force majeure or failures that the store cannot influence, shipping will occur immediately after their resolution. During periods of increased sales, in November and December, shipping times may be extended by up to 4 working days. In special cases, it is possible to arrange payment and delivery of goods based on individual terms agreed upon between the store and the customer.

§ 5

Warranty - Complaints - Returns

At Pendraqi.com, we offer new products that are free from factory defects and legally introduced into the Polish market or the European Union. In the event of a defect, the purchased item can be exchanged for a new one within 14 days from the date of receipt. To do so, this fact must be reported to pendraqi@gmail.com, and then the product must be returned within 14 days from the date of reporting.

The consumer has the option to return the product without giving a reason within 14 days, in accordance with the Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827 as amended). "A consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving any reason and without incurring any costs."

Products made to order or personalized cannot be returned. The item must be returned in its original and undamaged packaging, must not show signs of use, and must be free of defects, except for those that are the basis for a complaint. We guarantee a refund will be transferred to the specified account within 7 days.

In the case of receiving the order, the customer is obliged to check the goods and report any defects within 24 hours, returning the item within 14 days to the warehouse with a description of the defect. A defective item will be exchanged; if it cannot be exchanged due to being out of stock, the payment will be refunded to the specified account within 7 days.

The refunded amount is for the product only, not for shipping costs or return costs. In the case of non-collection of the shipment, the cost of shipping and return will be deducted from the cost of the product. If an order is not collected and is returned to us by the carrier, the carrier will additionally charge our warehouse with an extra cost for the return. In such cases, the refund for the product will be reduced by the shipping and return costs.

If a discrepancy in the order is noticed, this should be reported within 24 hours after receiving the shipment. Shipments sent cash on delivery are not accepted. Warranty is excluded and does not apply in B2B cooperation. In distance sales, a warranty card is not filled out as it is not required. The basis for filing a complaint is proof of order placement and payment.

After the complaint is filed, the product must be delivered within 14 days. The cost of delivering and collecting a complaint or return is to be borne by the partner. Please send shipments to the following address:

§ 6

Right of Withdrawal from the Contract

Based on the Act on the protection of certain consumer rights and on liability for damage caused by a dangerous product of March 2, 2000, the customer has the right to withdraw from the contract. The right of withdrawal from the contract is effective if the customer submits a declaration of withdrawal to the warehouse within 14 days of receiving the goods.

The customer returns the goods to the warehouse within 14 days of submitting the declaration of withdrawal from the contract. The returned goods should be in an undamaged state, including being complete, in the original packaging, and must not show signs of use. Shipping costs are borne by the customer.

Within 2 business days of receiving the shipment, the store will check the condition of the returned product. Within 7 days of checking the goods, the warehouse will refund the paid amount. The customer should provide the bank account number to which the refunded amount is to be transferred; in the case of payment by credit card, the refund will be made to that card.

If the customer breaches the conditions specified in paragraphs 2 and 3 above, the declaration of withdrawal from the contract is ineffective, the product cannot be returned, and the store will not refund the amount paid by the customer.

§ 7

Privacy Protection

By placing an order, the Customer consents to the processing of their personal data solely for the purpose of fulfilling the order. The Customer has the right to access their data and to have it corrected, as well as to request its deletion. The data of the store cannot be used or placed in personal offers, on corporate websites, or any other websites where the partner conducts sales or service activities.

Final Provisions

These terms and conditions come into effect on the date of publication on the website Pendraqi.com. The owner of the store reserves the right to amend the Terms and Conditions, which come into effect on the date of their publication on the wholesaler's website. For contracts concluded prior to the amendment of the Terms and Conditions, the version of the Terms and Conditions in force at the date of order placement by the Customer applies. Further use of the wholesaler at Pendraqi.com is associated with the acceptance of the Terms and Conditions in force at the time of placing orders and exercising copyright rights. The content of the online store does not constitute a commercial offer within the meaning of the Civil Code, Article 543. In the event of disputes, the competent court is the court of the defendant. After account activation, the services assigned to that account can be used. The wholesaler reserves the right to terminate cooperation with the customer at any time without giving a reason, especially if the customer violates these Terms and Conditions.
